Family Will

If I have a will and my husband has his own will...he has on his a different person then I do to have take care of our children when we are both gone. What happens to the children and who gets them? Also how do I get a free or cheap will?

This would be a problem if you & your husband died simultaneously in a car wreck, for example, but not an issue if you died even weeks, months or years apart. The execution of the 2nd will would then take over. In a simultaneous death, there would be legal confusion. Simultaneous deaths are very rare.

All this said, it would be better to be on the same page as your husband in reference to the care of your of your children. It's also important to let those you've chosen to take care of the kiddos know about your plans. There are no right answers to these questions, except the ones you can agree on.

In any legal document, you usually get what you pay for. Call a few attorneys that specialize in estate planning and see what they will charge. Getting a will done right will save dollars and headaches down the road.
